An Industrial Relations Commission hearing into the union ban on the new fleet of bendy buses has been told the matter isn't a safety issue.
79 expensive bendy buses suffered a driver ban with those behind the wheel claiming they have break problems.
State Transit disagrees and has taken the matter to the Industrial Relations Commission in a bid to get the buses based at Ryde, Brookvale, Waverly and Mona Vale back on the road.
Council for State Transit Peter Newell has told the hearing it’s not a safety issue, as the buses have been on the road since 2005.
Mr Newell also told the commission that the union indicated there wouldn’t be strike action while new software was being trialed for the buses.
The union’s defence replied that the buses aren’t safe and that having them on the road could lead to drastic and severe consequences.
The matter is now being heard in private.
State Transit Chief Peter Rowley is confident the buses will get the go ahead to return to service.
