Man likely to avoid jail over HIV sex case

A man who had unprotected sex with a woman knowing he was HIV positive is likely to avoid prison.

Lam Kuoth, 28, of Geelong, has pleaded guilty to two charges of recklessly endangering another person.

Kuoth had sex with a woman twice on April 22, 2007 after they went to a nightclub in Chapel Street.

He did not inform the woman he had HIV.

Victorian County Court Judge Paul Lacava today indicated he was prepared to place Kuoth on a suspended sentence for one charge and a community-based order for the other.

"I am most anxious to ensure the community's protection if there was any release of this person," Judge Lacava said.

"I am particularly concerned to ensure any conditions I impose are well thought through.

"This is a particularly sensitive case and an unusual case."

Judge Lacava released Kuoth on bail to be sentenced at a date to be fixed.
