Queensland's Court of Appeal will today hand down its decision on whether pedophile Dennis Ferguson can receive a fair trial.
Ferguson, 60, had been due to stand trial last month for allegedly sexually assaulting a five-year-old girl at her home in Dalby, west of Brisbane, in November 2005.
However, the case was thrown out by Brisbane District Court Judge Hugh Botting, who argued that the crown case was "tenuous" and that pre-trial publicity about Ferguson's past convictions would make it difficult to find an objective jury.
Ferguson has previously served time for child sex offences.
He was sentenced to 14 years jail in 1988 for sexually abusing three children in a Brisbane hotel room.
He had been out of jail for about two years before he was arrested on the charges that were recently stayed.
State Attorney-General Kerry Shine lodged an appeal over Judge Botting's decision, which was heard late last month.
The Court of Appeal will hand down its ruling this morning.
