Man loses appeal after killing brother with car

29/08/2008 3:00:00 PM.  |
A man who ran over and killed his brother following an argument about a stolen petrol cap has had an application for a reduced sentence denied.

Mohammed Farouk Hijazi was 24 years old when he ran down Toufik Hijazi, 26, outside their family home at Sunnybank Hills, in Brisbane's south, on August 1, 2006.

Toufik suffered broken legs but developed an embolism during surgery and died four days later.

The court was told the brothers became embroiled in an argument when Toufik accusing his younger sibling of stealing his petrol cap.

The dispute escalated to a point where Hijazi ran down his brother who had been standing on the street threatening Hijazi with a house brick.

He was sentenced to five years jail to be suspended after two years.

Hijazi had argued to the Court of Appeal in Brisbane that the sentence had been excessive.

But the court today ruled the sentence was not excessive and dismissed the appeal.
