Majority of paedophiles 'escape conviction'

A damning report has found children are more at risk of being abused by paedophiles, with 95 per cent of child sex offenders escaping conviction.

The Australian Law Reform Commission has found over the past decade the number of children needing protection has tripled to more than 300,000.

Report author James McDougall sums it up by saying we've let our children down.

"Child protection is just one of those areas, we should be creating environments where our children are better off and protected."

With only five per cent of child sex offenders being convicted, the report has found often families are discouraged from pursuing cases of abuse.

The Federal Government has largely ignored a 1997 study which called for a national Children's Comissioner - only Western Australia has adopted a key recommendation to allow children to give evidence via videotape.

As a child I became a survivor of rape. As an adult I witnessed a serious abuse situation, and despite correctly reporting it I was abused and harassed. While I would report things if I saw them again, I don't think the authorities have learned their lessons regarding child welfare. I reported this to the police, but there is little they can do, as my issues are now largely political. Still, I would like the hard questions asked of the right people.

If anyone ever touches any of my children, they would need to hope somebody else reports it to the police and that they arrive before I do. If the police got there after me ... the offender would certainly not be a problem for any other child. I would not hesitate. Clearly, the law is not looking after the children. It's beyond me what's going through the heads of the judges and why they just don't consider these crimes 'that bad' ... it's hard not to be a consipiracist. Beam me up.

Why on earth would politicians want to fix this when they have these creeps in the system and protected by their very own while they gain brownie points on their way up the scale and status for having worked in community service-think of the benefits they get for doing nothing-the example of Okropolous should be ringing bells to everyone including the federal govt who as everyone should know laws of the commonwealth prevail over laws of the state but who is brave enough to enforce them?Could that study mentioned in this article have been the Royal Commission into corruption in the Police force conducted in1997 by Justice Woods the same person selected to do the Inquiry into the dysfunctional operations of DOCS which is still not finalised and the findings delayed to later this year(DOCS was also mentioned in that inquiry back in 1997 but did anything improve!!? - and where pedophiles were protected and allowed to work and return to work however later given the opportunity to be medical

medically retired by a specific and so called "independent body" the govt dept uses. These pedophiles instead of disciplinary action being undertaken were rewarded and able to get their hands on their superannuation - what a rort it is when you have other public servants who speak out against corruption stripped of all their rights by this same medical body giving the green light to the employer to terminate their employment).The 1997 report is public knowledge.

yes the anguish of having to put my daughter through questioning in court was something i struggled with. she had suffered so much. she had been questioned for hours and was tormented from it. she was 5. its a very difficult decision. the courts need to work out a better system so that the children are looked after better. and these people can be punished without the children being punished.

There is little wonder why these preditors get off; when you look at the dribble and personal attacks in against me and my standing up against the Henson photos. The lunatics who could not/ would not see the wrong in what they were saying are the same ones who will be called up to be on the jury of paedophiles. Of course the paedophiles will get off when you read the attitude on this subject. The protection of children takes second place over "ART" in our society now days.

yes james, i read their comments, it makes it difficult doesnt it. they dont realise that everything is different now. its not about just a blurred picture hanging in a gallery. its a clear photo showing every detail and it gets put all over the world in seconds. its not art at all. des perpetrators are well looked after, legal aid etc. makes it very difficult when little ones are put up against these hard nose lawyers and have to face these criminals. yes susan whales do get more empathy

We think we live in a free Country but really we are ruled by indifferent systems. The system for dealing with this problem is weak and is more interested in process than results. It is up to people of good will to change the system that is responsible for this neglect. The system seems to be more concerned with protecting the rights of the perpetrators than with the protection of the innocent.

Des, RJ has it right, child abuse has tripled in the last 10 years since 1997 when the last report was done.TRIPLED. In a way I agree with James, you get attacked when you stand up for protecting children.Neighbours will call the RSPCA if a dog is being treated cruelly next door, but stay silent if it is a child.We see more concern for a stranded baby whale than we do for 7 yr old starved to death by her parents.A jury free's 2 carers who allowed a little 12 yr old to lay in the backyard and die

Society has gone to hell in a hand basket while good men do nothing.The system no longer protects the law abiding citiens but seeks to protect the offenders.Derryn Hinch has been castigated and jailed for naming convicted peadophiles freed and in our communities.Go and read the comments calling for him to be jailed.He has been jailed for this before, and never once put a victim at risk, but they still rail against him. people dont care anymore Des, it is as simple as that.Whales get more empathy

The whole system needs a full review and the only ones that can change this is people like James and those who know this is wrong and bring it to the noses of the politicians - these forums don't help - write to the politicians - I for one do not believe in the jury system as no one can be considered your peer especially when they have their own biased views and what they think may be right - what most people need to do is put themselves in the shoes of the victims. How many would think that this in fact was art?!! - there's plenty here tht do and of course being jury members this would be influencing their decision and not what evidence was before them - what it needs is going by what is written as law and that law should also be changed to protect the innocent and not the guilty - the Judge should make the final decision based on all the evidence and witness statements presented and then perhaps there will be some justice but as it stands now it just doesn't work!
