A former Melbourne restaurant owner who allegedly underpaid staff by at least n $125,000 is to face court.
The federal Workplace Ombudsman has started legal proceedings against the former owner of Malaysian restaurant KayuBoxhill, which is no longer operating.
The Ombudsman alleged one former staffer received just $9,650 for 18 months full-time work and is still owed $88,000 in back pay.
Documents filed in the Melbourne Magistrates' Court alleged the man underpaid 14 of his employees - including a 457 visa holder - around $125,000.
A part payment of $25,000 has been made, but $96,000 is still owing.
The former owner is being prosecuted for breaches of both the Liquor and Accommodation Industry Victoria Award and the Australian Fair Pay and Classifications Standard.
If convicted, he faces a maximum penalty of $33,000 per breach.
